Revocation of Classification as Community Land

Project Overview

Council is proposing to revocate a section of land which is located on the northern side of Davoren Road, currently utilised as a drainage reserve (Allotment Piece 1003 Davoren Road, Smithfield Plains and Portion Allotment 101 Stebonheath Road, Smithfield Plains & Andrews Farm.)

BACKGROUND

Pursuant to Section 194 (2) of the Local Government Act 1999, all land (except roads) that is owned by Council or under Council’s care, control and management is taken to have been classified as community land unless Council has resolved to exclude the land from classification as community land.

DISCUSSION

Council is proposing to revocate a section of land which is located on the northern side of Davoren Road, currently utilised as a drainage reserve (Allotment Piece 1003 Davoren Road, Smithfield Plains and Portion Allotment 101 Stebonheath Road, Smithfield Plains & Andrews Farm.)

Subject to completion of the revocation process, it is proposed that a portion of the land will be utilised for public road access (Council owned) onto adjoining parcel with the remaining land to continue to be retained for drainage/easement purposes. All land is to be retained in Council ownership.

A copy of Council’s Section 194 report detailing the proposal has been provided and the full Council report as adopted by Council at their meeting on 23rd Feb 2021 is available for your inspection upon request or at the locations:

Playford Civic Centre - 10 Playford Boulevard Elizabeth
Stretton Centre – 307 Peachey Road, Munno Para
Playford Operations Centre – 12 Bishopstone Road, Davoren Park.

Any objection to the proposal must set out the full name and address of the person making the objection and with supported reasoning. Submissions can be made in writing and must be received no later than Friday 16 April 2021.

Submissions can be addressed to: Chief Executive Officer, Playford Operations Centre, 12 Bishopstone Road, Davoren Park SA 5113 and received by close of business 16 April 2021.

The Council will consider all submissions relating to the proposal received by the due date. Where submissions are made, Council will provide notification of a meeting to consider the matters accordingly.
