Proposed Road Closure – Portions of Unmade Road, Yattalunga

Council is seeking community feedback on whether to proceed with the proposed closure of portions of an unmade road reserve near Glenburnie Road, Yattalunga.

If approved, the land would cease to be a public road and may be offered for purchase to adjoining landowners in accordance with the Roads (Opening and Closing) Act 1991 and the Local Government Act 1999.

Why is Council considering this proposal?

Following enquiries from adjoining landowners, Council is considering the formal closure of portions of an unmade road reserve near Glenburnie Road, Yattalunga.

In accordance with the Roads (Opening and Closing) Act 1991, the City of Playford is seeking community feedback on the proposal.

What is an unmade road reserve?

An unmade road is land that has been legally dedicated as a public road but has not been constructed or developed for vehicle access.

The unmade road reserve subject to this proposal passes through a number of rural properties and has been inaccessible to the public for an extended period. The land is currently fenced and there is no evidence of current public use. Due to the steep terrain and physical constraints of the site, there are no plans to develop the road for public access.

If approved, the land would cease to be a public road and may be offered for purchase to adjoining landowners in accordance with the Roads (Opening and Closing) Act 1991 and the Local Government Act 1999.

All costs associated with the road closure process, including survey, valuation, legal and administrative costs, will be met by the purchasers.

Next steps

Once the consultation period closes, all submissions will be reviewed and considered before Council determines whether to proceed with the proposed road closure.

If objections or easement requests are received, they will be considered in accordance with the requirements of the Roads (Opening and Closing) Act 1991. Submitters may be invited to attend a Council meeting or hearing to present their views and will be notified of any relevant meeting details.

If no objections are received during the consultation period, Council will proceed with making the Road Process Order.

Following the making of the Road Process Order, the Stage 2 Lodgement must be completed. In accordance with Section 20 (1) of the Roads (Opening and Closing) Act 1991, the Stage 2 Lodgement is required to be lodged with the Surveyor- General within three months of the Road Process Order being made.
