Proposed Road Closure - Portions of Beagle Hole Road and unnamed Road, Riverlea Park

Council is seeking community feedback on whether to proceed with the proposed closure of portions of Beagle Hole Road and an unnamed public road, Riverlea Park.

In accordance with the Roads (Opening and Closing) Act 1991, the City of Playford proposes to close portions of Beagle Hole Road and an unnamed public road. These sections are identified as ‘A’, ‘B’, and ‘C’ & ‘D’ on Preliminary Plan 25/0013, available in the document library on this page.

Why is Council considering this proposal?

The proposed road closures are required to support the construction of a stormwater drainage channel towards the Thompson Creek outfall from Carmelo Road. The stormwater channel route is required to cross small sections of the Beagle Hole Road reserve and the unnamed road reserve. The drainage channel forms part of an ultimate stormwater management solution for the Riverlea development with the stormwater infrastructure to be vested into the ownership of Council once construction is complete.

The remaining unmade and unaffected portions of the road reserve will ultimately be developed for urban purposes in the medium to long term.

Council is seeking feedback on the proposed road closure as part of the statutory consultation process. This includes consultation with directly affected property owners, relevant stakeholders, service authorities and the community. All submissions received will be considered before Council determines whether to proceed with the proposed road closure.

If the road closure proceeds, Council may consider the future disposal of any land that is no longer required for road purposes. Any disposal would be undertaken in accordance with the Local Government Act 1999 and Sales & Disposal of Land and Other Assets Policy.
 

What is an unmade road?

An unmade road is land legally designated as a public road but has never been constructed or used as one. It may appear as open paddock, grassland, or a track, but it is officially recorded as road reserve.

Note: Although the land may be disposed of following the statutory process, easements will be established to ensure public infrastructure, such as stormwater drainage, remains accessible and protected. These legal arrangements allow Council or utility providers to maintain and operate infrastructure on the land.

Next steps

Once the consultation period closes, all submissions will be reviewed and considered before Council determines whether to proceed with the proposed road closure.

If objections or easement requests are received, they will be considered in accordance with the requirements of the Roads (Opening and Closing) Act 1991. Submitters may be invited to attend a Council meeting or hearing to present their views and will be notified of any relevant meeting details.

If no objections are received during the consultation period, Council will proceed with making the Road Process Order.

As part of the proposed road closure process, Council is proposing to retain a portion of the land and transfer the remaining portion to an adjoining landowner for amalgamation with their existing property. Any proposed transfer will be undertaken in accordance with the requirements of the Roads (Opening and Closing) Act 1991. Any agreement relating to the transfer of the land must be finalised before the Road Process Order for the road closure is made.

Following the making of the Road Process Order, the Stage 2 Lodgement must be completed. In accordance with Section 20 (1) of the Roads (Opening and Closing) Act 1991, the Stage 2 Lodgement is required to be lodged with the Surveyor- General within three months of the Road Process Order being made.
